Secretary of State Bob Evnen said that the proposal doesn’t adhere to the requirements of the ballot for a single topic. Also, the proposal contained vague language. Sponsors of the issue told the Supreme Court that dividing the topic into three separate votes was to comply with the single-topic requirement.

Also, the sponsors said that the court hadn’t withheld a proposed amendment from the ballot due to voter confusion. However, critics of the measure argued that the proposal would allow casinos on tribal lands. Supporters of the measure said that there was no hidden authorization for casinos.
